User Agreement
Effective Date: February 1, 2026
Health & Help assists people in places where it is difficult or impossible to access basic medical care. We do this through the effort and resources put forth by volunteers and donors. We improve by helping others.
This User Agreement (“Agreement”) governs your access to and use of the Health & Help website and related services.
1. Introduction
1.1 Binding Agreement
By accessing, browsing, registering on, or using the Health & Help website or any related services (collectively, the “Services”), you agree to be bound by this Agreement.
Your use of the Services is also subject to our Privacy Policy, which describes how we collect, use, store, and share personal data.
The Privacy Policy forms an integral part of this Agreement and is incorporated by reference. Personal data is processed in accordance with applicable data protection laws.
If you do not agree to this Agreement, you must not access or use the Services.
You may terminate this Agreement at any time by discontinuing your access to and use of the Services.
1.2 Parties
This Agreement is entered into between you and Health & Help, Inc. (“Health & Help,” “we,” “us,” or “our”).
For purposes of this Agreement, any individual who accesses or uses the Services is referred to as a “Visitor.”
1.3 Scope of Services
This Agreement applies to the website he-he.org and any other websites, applications, or services operated by Health & Help that reference this Agreement.
1.4 Changes to This Agreement
We may update this Agreement or our Privacy Policy from time to time.
If we make material changes, we will provide notice through the Services or by other reasonable means prior to the effective date of the changes. Changes will not apply retroactively.
Your continued use of the Services after the effective date of any updates constitutes your acceptance of the revised Agreement.
2. User Obligations
2.1 Eligibility
You represent and warrant that:
- You are legally capable of entering into a binding contract; and
- You are at least 18 years of age.
If applicable law requires a higher minimum age for lawful processing of personal data without parental consent, you must meet that higher age requirement.
The Services are not intended for use by individuals under the applicable minimum age.
2.2 Donations
All donations made through the Services are voluntary and, except where required by applicable law, final and non-refundable.
Health & Help is a tax-exempt public charity described under Section 501(c)(3) of the U.S. Internal Revenue Code. Donations are used in accordance with our charitable mission and governing documents.
2.3 Opportunities Vacancies and Volunteering
Information published in the “OpportunitiesVacancies” section of the Services is provided for general informational purposes only.
Each opportunity vacancy description outlines key terms and requirements in summary form. Detailed terms and conditions are communicated during individual interviews or further recruitment stages.
Nothing on the Services constitutes an offer of a fellowship or creates a fellowship, contractor, or agency relationship between you and Health & Help. Participation in volunteer activities is voluntary and unpaid unless expressly agreed otherwise in writing.
2.4 Communications
You agree that Health & Help may communicate with you regarding the Services by:
- displaying notices within the Services; and
- sending messages to the contact information you provide, including email addresses or telephone numbers.
3. Rights and Limitations
3.1 Availability of Services
We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.
3.2 Usage Limits
We may impose reasonable limits on the use of the Services, including restrictions on access, features, or interactions, in order to maintain security and operational integrity.
3.3 Intellectual Property
All rights, title, and interest in and to the Services, including all content, software, trademarks, and logos, are owned by or licensed to Health & Help.
Nothing in this Agreement grants you any ownership or license rights except as expressly stated.
4. Disclaimer and Limitation of Liability
4.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEALTH & HELP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
The Services do not provide medical advice and are intended for general informational and humanitarian purposes only. Any medical information made available through the Services is not a substitute for professional medical advice, diagnosis, or treatment.
4.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEALTH & HELP AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, BUSINESS OPPORTUNITIES, OR REPUTATION;
- LOSS, MISUSE, OR CORRUPTION OF DATA; OR
- ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
Nothing in this Agreement limits or excludes liability where such limitation or exclusion is not permitted under applicable law.
5. Termination
Either you or Health & Help may terminate this Agreement at any time by providing notice to the other party , where permitted by law.
Upon termination, your right to access or use the Services immediately ceases.
The following provisions survive termination:
- Section 4 (Disclaimer and Limitation of Liability);
- Section 6 (Governing Law and Dispute Resolution);
- Section 7 (General Terms);
- Section 8.2 (Don’ts);
- Any obligations accrued prior to termination.
You may request account closure by contacting support@he-he.org.
6. Governing Law and Dispute ResolutionThis Agreement is governed by and construed in accordance with the laws of Washington, D.C., United States, except where mandatory local law provides otherwise.
Any dispute arising out of or relating to this Agreement shall be resolved exclusively in the courts located in Washington, D.C., unless prohibited by applicable law.
7. General Terms
If any provision of this Agreement is held unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the remaining provisions.
This Agreement constitutes the entire agreement between you and Health & Help regarding the Services and supersedes all prior agreements or understandings.
Failure by Health & Help to enforce any provision shall not constitute a waiver of that provision.
You may not assign this Agreement without our prior written consent. Health & Help may assign this Agreement without restriction.
There are no third-party beneficiaries to this Agreement.
Legal notices must be sent using the contact information provided in Section 9.
8. Health & Help Code of Conduct
8.1 Dos
You agree to:
- Comply with all applicable laws and regulations;
- Provide accurate and current information;
- Use the Services in a lawful, ethical, and mission-consistent manner.
8.2 Don’ts
You agree not to:
- Use automated systems to access or scrape the Services;
- Circumvent security or access controls;
- Copy, distribute, or disclose content without authorization;
- Infringe intellectual property rights;
- Reverse engineer or attempt to derive source code;
- Misrepresent affiliation with Health & Help;
- Use the Services for unlawful or abusive purposes;
- Frame, mirror, or materially alter the appearance or functionality of the Services;
- Interfere with the operation or performance of the Services.
